Passenger Transport and Service Agreement

1-Parties:

Antalya Doğan Transfer Tourism Elak Construction Food Trade and Industry Limited Company will be referred to as ‘Antalya VIP Transfer’ in short.

The person whose name and surname are specified in the reservation and/or the persons he/she represents will be referred to as ‘’Consumer or Customer’’.

2-Subject:

This agreement is made between the consumer and Antalya VIP Transfer. This agreement is arranged for the services specified on the Antalya VIP Transfer website, the qualifications and sales conditions of which are made for the service sales made by telephone or electronically and covers the rights and acquisitions of the parties.

With this agreement, the parties have agreed on the provision of transfer service from the addresses or hotels determined by them before and after the flight to the airports and/or vice versa, and the performance of this service by Antalya VIP Transfer for a fee, within the framework of the following contract conditions.

3-Service and Payment Information

- The contract price is the amount specified in the reservation confirmation form.

- Requests for different points other than the route(s) specified in the reservation in the private transfer service; If it is on the route and without waiting, it is included in the price, if it is not on the route, the amount determined by Antalya VIP Transfer for each different point is paid by the passenger in the region.

- Antalya VIP Transfer has the right to make changes to the transfer vehicle without any fee change without notifying the consumer when necessary. If the customer does not accept this change, he/she has the right to cancel his/her reservation and receive the full amount of the fee he/she paid. In this case, the customer does not have the right to compensation.

- With this contract, the consumer authorizes Antalya VIP Transfer to collect the service fee with the credit card information he/she has entered in the system. Antalya VIP Transfer system is encrypted with 3D Security and the consumer is responsible for the credit card information he/she has entered.

- The invoice issuance period for the purchased service is 7 days including the date of purchase, provided that no month is skipped, as per VUK.

- Bank (Bank transfer to company accounts / EFT)

- Credit Card (online payment via the website)


6-Number of Persons: The number of persons must be specified by the consumer.


7-General Provisions

Passengers are required to wear seat belts for traffic laws and life safety.

Even if the consumer cannot sign this contract by receiving it with a bank or credit card for any reason, the consumer is deemed to have learned the contract terms that will be valid between the parties through the website or advertisements and has accepted to receive the service under the written terms in the contract.

In order to benefit from the service that is the subject of this contract, the consumer must have made a reservation at least 6 (six) hours before the service time. On religious and national holidays, New Year's Eve and official holidays, a reservation must be made at least 48 (forty-eight) hours before the transfer time. The reservation can be canceled by the customer up to 6 hours before. In this case, the customer will be refunded. In case of later reservation cancellations, the service fee will not be refunded. The route to be followed from the departure point to the arrival point during the service is determined exclusively by Antalya VIP Transfer, taking into account traffic, road conditions and other criteria. In transfer services other than allocation and tour services, the customer does not have the authority to change this route. In this context, requests for the passenger to stop by a different location between the determined routes and to wait for a while at this location cannot be accepted. Antalya VIP Transfer is only obliged to transport the customer from a point to a specified point, from the point to the airport or from the airport to a certain point. Antalya VIP Transfer is obliged to allocate a vehicle suitable for the number of passengers and luggage volume determined by the consumer at the time of online purchase. Antalya VIP Transfer; hereby undertakes that all vehicles to be allocated to the service subject to this contract will be fully insured, their periodic maintenance will be fully performed, and that the necessary spare tire, first aid kit, fire extinguisher, reflector, etc. materials will be available in the vehicle. Antalya VIP Transfer will not be responsible for any physical or material damage to the customer or damage to the transported goods due to any traffic accident or other reason that may occur during the service. In such a case, the customer irrevocably accepts and declares in advance that Antalya VIP Transfer will not have any liability arising from Article 66 of the Code of Obligations and other provisions of the legislation. Despite the allocation of a suitable vehicle, if the number of people and the amount of luggage determined by the customer at the time of purchase are exceeded, the transfer will be carried out without exceeding the legally determined carrying limits of the vehicle. Passengers or luggage exceeding the legal limits will not be accepted to the vehicle. If the customer cancels the transfer service for this reason, no refund will be made. The customer is obliged to document with the identification documents issued by the legal authorities or the reservation document to the Antalya VIP Transfer personnel in the vehicle at the transfer point that they are the customer who purchased the service. The transfer of the customer who does not fulfill this obligation will not be made. In cases where the customer has previously made a reservation for the transportation service but due to changes in flight programs or in operational cancellations and/or other delays, the customer is obliged to inform Antalya VIP Transfer by phone or by sending an e-mail to info@antalyavipransfer.com. In the event of a delay or route exceeding 3 hours, Antalya VIP Transfer has the right to change the terms of service without notifying the customer. In this context, if the flight is canceled for any reason, if the customer notifies Antalya VIP Transfer of the cancellation by sending an e-mail to info@antalyaviptransfer.com, if the transfer fee is paid, the refund will be made within 7 days at the latest via the customer's payment method without deduction.


It is the customer's responsibility to load the luggage completely and completely into the vehicles and to take it from the vehicle. Antalya VIP Transfer is not responsible for the loss and damage of items forgotten by the customer in the vehicle during the transfer. However, if the forgotten item is noticed by Antalya VIP Transfer personnel later, it will be delivered to the specified address within the borders of Antalya on the same day for an extra service fee upon the customer's request.

Antalya VIP Transfer is not responsible for carrying sacks, chests and similar items that may damage the vehicle as luggage during the service. Each passenger has a 20 kg baggage allowance per person. In the event of any loss or damage to luggage caused by Antalya VIP Transfer, the service fee for the items previously taken from the passenger and for which no value declaration has been made will be paid to the passenger as material and moral compensation. The customer accepts, undertakes and declares that there are no flammable, explosive, narcotic, liquid, odorous, radioactive or any substance prohibited by the Turkish Laws in the luggage subject to transfer. If the driver notices the presence of the listed substances in the luggage, the said luggage will not be accepted in the vehicle. If the transfer cannot be carried out during the discharge of the said substances from the luggage or if the customer cannot make it to the flight due to the time lost, no refund will be made. In addition, in this case, the customer cannot claim any rights or receivables under any name against Antalya VIP Transfer. If the presence of the above-mentioned substances in the luggage is noticed, the situation will be reported to the authorized authorities by Antalya VIP Transfer immediately. If the presence of the listed substances is not noticed by the driver and is detected by the police during the transfer by stopping and searching; any damages and losses that Antalya VIP Transfer will suffer due to this reason will be covered immediately by the customer in cash and in one go. The customer's pet transfer requests and the type of pet to be transported will be notified by the customer during the online purchase of the service. Animal transfer will not be made without such notification. Animal transfers are not made alone without an adult customer. The animal to be transferred under these conditions can only be carried in a special cage, in the section determined by the Antalya VIP transfer personnel in the vehicle, with all responsibilities belonging to the customer. It is not possible to transfer animals whose acquisition, possession and transfer are against the law according to the laws of the Republic of Turkey under any circumstances. In transfers from a certain point to the airport; Antalya VIP transfer declares and undertakes that the vehicle allocated for Antalya VIP transfer will be at the specified point at the transfer time. A delay of 15 (fifteen) minutes from the transfer time will be considered a reasonable delay. In case of a delay exceeding 15 (fifteen) minutes, the customer does not have to wait for the vehicle. In this case, the transfer fee is refunded to the customer. In transfer points such as sites and mass housing; if the 15 (fifteen) minute delay period is exceeded due to the site security guards preventing the vehicle from entering the site, the responsibility does not belong to Antalya VIP transfer. If 15 (fifteen) minutes is exceeded in this way and the customer does not wait for the vehicle, the fee will not be refunded. The customer must be ready at the specified point with their luggage at the transfer time. If the customer is not present at the transfer point at the transfer time, the Antalya VIP transfer allocated vehicle is obliged to wait for the customer for 15 (fifteen) minutes. 15 (fifteen) If the customer does not reach the designated point with their luggage at the end of the minute, the vehicle is not obliged to wait any longer.

At the transfer point, Antalya VIP Transfer personnel are not obliged to leave the vehicle and carry luggage, pet cages, or accompany the passenger to the vehicle.

Children under the age of twelve will not be transferred without their adult companions. The transfer of the companion back to the point where they were picked up depends on the purchase of the return service on the website. If a wheelchair transfer is also requested with the customer to be transferred, this will be notified by the customer during the online purchase of the service. If the customer states this when purchasing the service online, a baby seat will be placed in the vehicle to be allocated by Antalya VIP Transfer.

In cases where the service subject to this contract is interrupted or cannot be performed due to weather and road conditions, vehicle malfunction, sudden health problems related to the customer or driver, checks to be carried out by the law enforcement during the transfer, and other reasons, and in cases where the passenger cannot make it to the flight for these reasons; Antalya VIP Transfer is only liable to refund the pre-paid service fee to the customer. The provisions of this agreement that stipulate situations where no refund will be made are reserved. The customer accepts, undertakes and declares that Antalya VIP Transfer has no obligation to compensate for the flight ticket and other material/moral damages other than the obligation to refund the fee. In the event that the customer cancels the transfer during the transfer; Antalya VIP Transfer has no obligation to transfer the customer back to the point of pickup. If the vehicle's work schedule does not allow it, the customer will be left in the nearest residential area in accordance with the traffic rules. In such a case, no refund will be made. If the customer requests to return to the point of pickup and complete the transfer due to forgotten items or any other reason during the transfer, Antalya VIP Transfer has no such obligation. It is up to Antalya VIP Transfer to fulfill this request of the customer to the extent that the vehicle's work schedule allows. In such a case, Antalya VIP Transfer is not responsible for the customer not being able to catch the flight and suffering any other damages, and no refund will be made. In the event that the passengers or animals carried in the vehicle during the transfer experience any health problems; antalya vip transfer personnel are obliged to transfer the passenger immediately to the nearest health unit. Any request by the passenger to the contrary does not bind antalya vip transfer personnel. The nearest health unit may be official health institutions or private health institutions. Antalya vip transfer is not responsible for any death, bodily injury, material or moral damage that occurs during and after the transfer of the passenger/animal with health problems to the nearest health unit. At the end of the transfer, the customer is obliged to sign the notification document stating that they have purchased the service and reached the destination. If the customer requests, the invoice for the service provided will be sent by Antalya vip transfer to the address specified by the customer. is authorized.

8-Force Majeure

In the event that the parties fail to fulfill their obligations under this contract due to any kind and nature of force majeure not caused by them, natural events, adverse climate conditions, social events, public movements, events occurring due to negative developments in working life, all kinds of legal or illegal worker or employer movements, strikes, lockouts, union movements and slowdowns, war, armed conflict, revolution, declaration of martial law or state of emergency, conflicts and riots between groups. This contract will remain suspended until the end of the listed situations/negative effects. The contract will come into force again upon the end of the listed situations/negative effects. The failure of the parties to fulfill their obligations as a result of force majeure does not grant the other party the right to terminate or claim compensation.


9-Cancellation Conditions and Other Provisions

No cancellation, change or refund can be made for any reason on the campaign product purchased by the passenger. Applications made to the bank or Antalya VIP Transfer for cancellation and refund requests for reservations that have passed the date and time are invalid.


10-Authority

TC Laws will be applied and Antalya Courts and Enforcement Offices will have jurisdiction in the resolution of all disputes arising from the implementation of this contract.


11-Enforcement

Passengers who do not sign the contract but receive the service subject to the contract are deemed to have accepted the provisions of the contract by having the 3rd parties they have assigned to register on their behalf read and sign this contract. This contract has been prepared in 2 copies and signed by the parties, and in disputes arising from the contract, the Highway Transportation Law No. 4925 and other articles of the TC legislation will be applied.
